Homeopathy and the Federal Trade Commission: Policies for the 21st Century by Diane M. Miller JD Homeopathy is an energy medicine giant that is key to the health awakenings of the 21st Century. Current laws and public policy will have to be evaluated and designed with homeopathy’s impact in mind. Homeopathic remedies are currently in a cross-fire between two federal agencies, the FDA and the FTC, because health claims on homeopathic products bring up the direct overlap of current legal jurisdiction between these two federal agencies. The overlap is based on this:  The FDA regulates the labeling of all food and drug products.  Homeopathic remedies are considered drugs and thus their labeling is under the jurisdiction of the FDA.  The FTC regulates advertising or labeling of products in commerce and prohibits unfair or deceptive acts in commerce.  Homeopathic manufacturers advertise their products thus are under the jurisdiction of the FTC. The FDA has developed special marketing guidelines for homeopathy.  They have guidelines for regulation of over-the-counter (OTC) homeopathic products, based on the FDA’s understanding that “due to the uniqueness of homeopathic medicines” they are deserving of clear conditions for marketing.  These guidelines have resulted in protection of consumer access to these safe products.  The FDA has specifically spelled out the requirements for the labeling of homeopathic products given their Hahnemannian principles of dilution.  Since 1988, the FDA regulates homeopathic over-the-counter (OTC) remedies under their Compliance Policy Guide (“CPG”) entitled “Conditions Under Which Homeopathic Drugs May be Marketed”.  It permits the marketing of homeopathic products “intended solely for self-limiting disease conditions amenable to self-diagnosis (of symptoms) and treatment” as OTC products.  It requires that the labeling of OTC homeopathic drugs display an indication for use.  And it acknowledges the existence of the homeopathic research procedure, called “provings”, which is a homeopathic method of research employed in healthy individuals to determine the dose of a drug sufficient to produce symptoms and used to determine the eligibility of drugs for inclusion in the Homeopathic Pharmacopeia of the United States (HPUS). But the FTC also claims authority over claims on products in commerce under Sections 5 and 12 of the FTC Act, and their authority could conflict with the FDA’s labeling requirements for homeopathy.  For example, FDA’s regulations require that OTC homeopathic remedies display an indication for use on the label.  But FTC is now warning that they will require competent and reliable scientific evidence of statements made on labels.  And that those statements will be held to a conventional drug standard.   The FTC states as follows: “Section 5, which applies to both advertising and labeling, prohibits unfair or deceptive acts or practices in or affecting commerce, such as the deceptive advertising or labeling of over-the-counter (OTC) drugs.  Section 12 prohibits the dissemination of false advertisements in or affecting commerce of food, drugs, devices, services, or cosmetics.  Under these provisions, companies must have a reasonable basis for making objective claims, including claims that a product can treat specific conditions, before those claims are made. For health, safety, or efficacy claims, the FTC has generally required that advertisers possess “competent and reliable scientific evidence,” defined as “tests, analyses, research, or studies that have been conducted and evaluated in an objective manner by qualified persons and are generally accepted in the profession to yield accurate and reliable results.”  Competent and reliable scientific evidence may take different forms depending on the type of claim being made.  For some claims, the substantiation required may be one or more well-designed human clinical studies.  Neither the FTC Act, nor any FTC rule or policy statement, exempts advertising claims for homeopathic drugs from these standards.” The FDA’s regulations historically have been structured in a way that has treated OTC homeopathic remedy health claims as if homeopathic remedies are safe.  However, the FTC, appears to be considering them as dangerous drugs and is applying a conventional drug standard to speech regarding homeopathic remedy health claims. The problem is that FTC is using the wrong standard for assessment of the health claims for homeopathic remedies.  Here is why.  As explained simply and clearly by leading homeopath John Melnychuk, RSHom (NA) CCH: “Homeopathy has a scientific paradigm of its own, which is distinct from western scientific understandings.  (Similarly, the science and paradigm that underlies Chinese Medicine and acupuncture are not readily explainable by western medical science.  It is unwise and arbitrary to judge one system with the standards of another.)   It is agreed upon by most that homeopathic medicines are not toxic, and therefore the rules for the necessity and method of proving safety are not relevant or reasonable in the same way as they are for dangerous drugs.”   Conventional prescription drug health claims, because of the dangerous nature and known history of side effects of drugs, understandably require proof of any promise or health claims made, because the consumer has to choose between two possibilities: the dangerous side effects including sometimes possible death from a drug, or ongoing illness and potential death from a disease.  It is important for consumers to have truthful information on whether there is a chance of getting cured by the product given those two options.  Consumers need to know the effectiveness of pharmaceutical prescription drugs because they have to weigh the potential benefits against the danger to themselves. But in the instance of a product that is generally regarded as safe, the proof that a substance is effective is not as crucial. If there is little risk in trying some approaches, consumers want to have broad access to many options based on their own research.  That is why, for safe products like dietary supplements, food and homeopathic remedies, the consumer is most concerned with safety instead of proof of efficacy, and the role of government is not to ensure effectiveness, but rather to make sure that a product is not on the market that will hurt them.  And if there is a potential fraud or misrepresentation regarding a health claim for a product on the market, it is the responsibility of the FTC to stop the fraud, and they have the burden of proof to show misrepresentation or fraud before banning speech. We need to ask the important question as to whether the manufacturers of safe products be required to prove by conventional scientific methods that the health claims that they make about their products are truthful and not misleading before they have the freedom to market their product and speak about them, or should the government have the burden of proof to show that a statement is dangerous or fraudulent before taking a product off the market?  We believe that since the FTC regulates deceptive trade practices and wishes all statements to be truthful, the burden of proof of fraud must remain on the government for a product that is generally regarded as safe.  Otherwise most safe products would be banned and there would be a massive infringement on freedom of speech.  If that were the case nothing positive could be said about a product unless the manufacturer was a multimillion dollar company that could go through the high standard of proof that the FTC is suggesting.  Statements about the benefits of food and homeopathic products for sale have been made for hundreds of years, and the wisdom of the culture on these products must not be stifled by demanding the type of scientific proof required of dangerous drugs, costing millions of dollars, before one speaks. If something is safe, all citizens of the world should always be able to speak about it and have access to it.  And if a fraudulent commercial claim is made about a safe product, the government has the duty and the burden of proof to prove fraud before pulling from the market. NHFC opposes the following FTC recommendations based on our discussion above:  FTC recommends the following: “For the vast majority of OTC homeopathic drugs, the case for efficacy is based solely on traditional homeopathic theories and there are no valid studies using current scientific methods showing the product’s efficacy.  Accordingly, marketing claims that such homeopathic products have a therapeutic effect lack a reasonable basis and are likely misleading in violation of Sections 5 and 12 of the FTC Act.14 However, the FTC has long recognized that marketing claims may include additional explanatory information in order to prevent the claims from being misleading.  Accordingly, the promotion of an OTC homeopathic product for an indication that is not substantiated by competent and reliable scientific evidence may not be deceptive if that promotion effectively communicates to consumers that: (1) there is no scientific evidence that the product works and (2) the product’s claims are based only on theories of homeopathy from the 1700s that are not accepted by most modern medical experts.  To be non-misleading, the product and the claims must also comply with requirements for homeopathic products and traditional homeopathic principles.  Of course, adequately substantiated claims for homeopathic products would not require additional explanation.”
FTC’s requirement to add a statement to labels that “there is no scientific evidence that the product works”, is based on the FTC’s conventional scientific knowledge and methods, without recognizing the massive library of research and literature available in the homeopathic medical community regarding Hahnemannian principles and homeopathic research.  FTC’s requirement to add a statement to labels that “the product’s claims are based only on theories of homeopathy from the 1700s that are not accepted by most modern medical experts” is a denigration of a healing system used by millions world-wide.  It is promoting one system of medicine over another based on its dominance in the culture.  It has nothing to do with positive education of consumers.  It is based on an unwillingness to allow access by consumers to a minority system of healing, and ignores the potential benefit of simply ensuring safety, and providing education to consumers. In addition to these concerns, there is an additional, and much larger issue that the FDA and the FTC must eventually address regarding homeopathic products: that is the issue of the advancement of the understanding of the universe.  How does continued access to the broader conventionally un-proven truths of the universe interact with the current regulatory standard of “competent and reliable scientific evidence”?    The FTC refers to “modern medicine” and “reliable science”.  How can the research scientists, inventors and innovators experiencing and probing the complexity of the human experience and the universe, and consumer access to the knowledge that is forthcoming from them, be protected and encouraged, when government authorities attempt to block speech about, and access to, products unless healing efficacy has been proven based on conventional scientific methods?  Conventional science has expanded and grown over the years, but it may be said that conventional science is in the early stages of understanding when it comes to truths such as the foundations of homeopathy, the Hahnemannian principles, the law of similars and the process of dilutions and succussions. In the case of homeopathic remedies, there is agreement in government and civil society that thousands of homeopathic remedies and products do not pose an imminent risk of harm to individuals or the public.   We need to protect and encourage access to these safe products.  And we need to protect our personal freedoms to speak about health options and to make health care choices.  We must never allow government to quash speech and advertisements about safe products that are basically innovative applications of natural truths. It is our position at NHFC and NHFA that individuals should always be able to speak about and have access to all health care options that they desire that are generally regarded as safe and that government has the burden of proof to show misrepresentation or fraud when it comes to any health claim.  It is noticeable that these larger glaring issues were not addressed by the FTC.  That fact alone causes much consternation within the healing community. In Conclusion:  In this complex situation between FDA and FTC, the FDA has been doing a good job of walking the line effectively by protecting access for consumers to homeopathic products, while at the same time, making sure that consumers are obtaining safe products with appropriate labeling.  The FTC continues to have the authority to challenge fraudulent statements, and that is appropriate. We deeply hope that the FDA will uphold its homeopathic policies and protect consumer access to homeopathic remedies, and tell the FTC that they have over-stepped their jurisdictional boundaries.  Citizens need to ask the FDA to hold fast to their 1988 Compliance Policy Guide providing reasonable treatment(regulation) of homeopathic remedies. There is no need to denigrate homeopathy by forcing the additional requirements of disclosures to labeling or advertising that FTC proposes.

An Article On Ulcerative Colitis

This is a very good article I found on ulcerative colitis and IBS. The remedies indicated below are remedies that 'may' help some people and should never be taken on a long term basis without consulting a professional homeopath.


Ulcerative colitis is the inflammatory condition of the digestive tract, and is usually classified with  Inflammatory Bowel Disease (IBD). Ulcerative colitis is the inflammation in the large intestine (the colon) and the rectum. It affects the lining of the large intestine and rectum, and can produce painful ulcers. 


Ulcerative colitis is usually a long-term, or chronic condition. As the NHS Choices website says, the symptoms include bloody diarrhoea, abdominal pain, a frequent need to go to the toilet and weight loss. Loose stools mixed with blood are characteristic of ulcerative colitis, and the weakness caused by recurrent bloody diarrhoea can seriously affect quality of life, and lead to life-threatening complications.


However, the individual experience of Ulcerative Colitis, and IBS is very variable. It i for this reason that homoeopathy, as an individualised, and symptom based system of medicine, can be helpful in treating these conditions. 


Conventional Medical Treatment for Ulcerative Colitis
The NHS Choices website has been used here as the source of information about the conventional medical treatment of this condition. As the NHS Choices website says, “there is currently no cure for ulcerative colitis so the aim of treatment is to relieve symptoms during a flare-up and prevent symptoms from returning during remission – this is known as  maintenance therapy”.  


The NHS Choices website goes on to describe the available treatment for ulcerative colitis.


Aminosalicylates
These drugs are the first treatment option for mild to moderate ulcerative colitis. They can help reduce inflammation. NHS Choices says that the side effects of aminosalicylates can include:
     •     diarrhoea
     •     feeling sick
     •     headaches
     •     skin rashes
Corticosteroids
NHS Choices says that Corticosteroids (steroid drugs) may be used when the ulcerative colitis is more severe or not responding to aminosalicylates. Steroids act like aminosalicylates in reducing inflammation “except they are a lot stronger”. NHS Choices goes on to warn that the long-term use of steroids, especially oral steroids, is not recommended “as they can cause potentially serious side effects”. 


The side effects of short-term use of steriods mentioned by NHS Choices are:
*     changes in the skin such as acne
*     sleep and mood disturbance
*     indigestion
*     swelling


The side effects of prolonged steroid use (more than 12 weeks) include:
*     osteoporosis – weakening of the bones
*     high blood pressure (hypotension)
*     diabetes – or worsening of existing diabetes
*     weight gain
*     cataracts – where cloudy patches in the lens of the eye can make vision blurred or misty


Immunosuppressants
NHS Choices goes on to say that you may be given immunosuppressants “if your condition is still not responding to treatment, sometimes in combination with other medicines”. It says that Immunosuppressant drugs work by “reducing or suppressing your body's immune system”. 


NHS Choices describe the drawback to immunosuppressants is that “they affect your whole body, not just your colon. This may make you more prone to infection, so it is important to report any signs of infection, such as inflammation, fever or sickness, promptly to your GP. They can also lower the production of red blood cells, making you prone to anaemia. You will need regular blood tests to monitor your levels of blood cells and check for any other problems”.


Azathioprine
This drug is described as the ‘preferred’ immunosuppressant drug’ used in the treatment of ulcerative colitis, but NHS Choices says that the long-term use of azathioprine has been linked to a small increase in the risk of cancer, particularly skin cancer! It also not normally recommended for pregnant women.


“However, if it is the only treatment that successfully controls your condition, it is likely you will be advised to continue taking it. Any risk to you or your child is far outweighed by the risks presented by ulcerative colitis”.


NHS Choices continues by saying that severe active ulcerative colitis “should be managed in hospital to minimise the risk of dehydration, malnutrition and potentially fatal complications such as your colon rupturing”.


Infliximab
NHS Choices says that Infliximab is “a new type of medication only used to treat severe active ulcerative colitis if you are unable to take steroid medication for medical reasons, such as being allergic to it”. The describe the side effects of this drug to be
*     joint and muscle pain
*     itchy skin
*     high temperature
*     rash
*     swelling of the hands or lips
*     problems swallowing
*     headaches


NHS Choices then says that “there have been a number of cases where infliximab has "reactivated" a previously dormant tuberculosis (TB) infection. Therefore, it may not be suitable if you have a previous history of TB. The same is also true with the viral infection hepatitis B. Infliximab is also not recommended for people with a history of heart disease. Infliximab will make you more vulnerable to infection, so avoid contact with people who have a known chickenpox or shingles infection.


Surgery
NHS Choices says that if ulcerative colitis does not respond to intensive medical treatment, then surgery may be required, and that patients may wish to consider this if “the condition is affecting quality of life”.


According to NHS Choices, surgery involves permanently removing the colon – a colectomy, and the re-routing of the small intestine so that it can pass waste products out of your body. Apparently, according to NHS Choices, this surgery can now be done without the requirement to carry an external pouch.


Alternatively, of course, patients may want to choose a safer, more effective treatment for this disabling disease.


Homeopathic Treatment of Ulcerative Colitis


Homeopathy is a medical therapy that will avoid some of the side-effects and adverse reactions of conventional medical treatment. Homeopathy is the second most popular medical therapy in the world, and the most popular holistic system of medicine. Natrum Mur

Nux Vomica 
An excellent medicine for ulcerative colitis, if one studies the Nux Vomica, one sees a clear picture of this condition.


Lycopodium
This is another remedy that has a very close resemblance to the condition.


Merc Sol
This remedy also has a very close relationship with the pathology of ulcerative colitis (for instance, where the symptoms are of bloody slimy stools with a strong and constant desire to pass stool, and the ‘never get done’ feeling.


Yet there are many other remedies that match the symptoms of Ulcerative Colitis, including Merc Cor, Sulphur, and Phosphorus.


Hamemelis is a useful remedy for controlling the bleeding aspect of the disease. 


Ferrum phos and Ferrum metallicum are useful for correcting anaemia.




RANDOMISED CONTROLLED TESTS
RCTs are the third, and decidedly the least important type of evidence supporting Homeopathy as a medical therapy.


Study Proves the Effectiveness of Homeopathy for Managing Ulcerative Colitis

In this retrospective case analysis, 24 people suffering from ulcerative colitis were treated in an Argentinian clinic using constitutional homoeopathy over periods of up to 19 years. Of these 24, 16 patients were assessed as having good outcomes.

Usain Bolt Chooses Homeopathy

At the beginning of July 2016 Usain Bolt withdrew from olympic trials with a grade 1 tear in his hamstring. He immediately went to Germany for homeopathic medical treatment. An Open Letter From Concerned Physicians Regarding Antibiotic Resistance.
America and the world face a crisis.
It is now estimated that antibiotic resistant infections may kill an estimated 10 million people a year and cost the world’s economies some $100 trillion annually1 by the year 2050. Dr. Margaret Chan of the World Health Organization has recently stated that Earth may be approaching a time “when things as common as strep throat or a child’s scratched knee could once again kill.”
Solutions to this looming crisis must be found and found quickly. As some of America’s leading integrative medicine specialists, we believe it is time to look anew at a modality called homeopathic medicine.
Why homeopathic medicine?
As physicians, we are the first to acknowledge that the diagnostic and surgical tools of conventional medicine are scientific marvels - truly extraordinary and life saving. laboratories and others have found that homeopathic medicines, like modern engineered nanoparticles, have been found to act by modulating biological function of the allostatic stress response network, including cytokines, oxidative stress and heat shock proteins 7,8. Additionally, there are hundreds of peer-reviewed studies including randomly controlled trials and large observational studies on individual cells, plants, animals and humans, that show homeopathic medicines are exceptionally safe and have measurable and positive biological and therapeutic effects9.
Reliable and extensive clinical and public health records have also been carefully examined internationally, looking for evidence of homeopathic medicine’s efficacy during some of the deadliest epidemics of the past 200 years. The main findings of this research show that when homeopathic medicine was employed during these deadly events, mortality rates were routinely very low. This constancy remained regardless of the homeopathic physician, time, place or type of epidemical disease, including diseases carrying a high mortality rate, such as cholera, smallpox, diphtheria, typhoid fever, yellow fever, influenza and pneumonia10.
Some in the medical community will have reservations about exploring the potential of homeopathic medicine to treat dangerous bacterial infections and will base their objections on two factors: (1) the idea that homeopathic medicines at potencies above 12C contain no active ingredients and, (2) a study published by Shang, et. al. in 2005.
As stated earlier – nanoscientists at 12 independent research labs have now consistently confirmed that all medicines studied contain various nanostructures, including source and silica nanoparticles which are heterogeneously dispersed in colloidal solution – making homeopathic medicine the first known form of nanomedicine. What’s more – we now know from recent discoveries in nanoscience that each remedy manufactured using traditional methods of trituration and vigorous agitation must in fact contain nanostructures. As for the Shang study – it has been repeatedly invalidated by a number of medical researchers as methodologically flawed even within an allopathic medical framework11,12,13,14,15.
Finally – we make this recommendation while knowing that many of our colleagues will feel uncomfortable using homeopathic medicine singly. As a result – we are calling for a collaborative effort to investigate the efficacy of homeopathic medicine in the treatment of patients with these increasingly dangerous infections whereby homeopathic medicine is used only as an adjunct to conventional therapies.

Fevers

I'm often asked by patients the best way to treat a fever, generally speaking parents are somewhat afraid when their child develops a fever, however a fever is the body doing what it does best 'attempting to heal itself' and like all other acute diseases should be left alone. Acute disease allows the body to build an immune system and help burn out more chronic disease so never be in a hurry to suppress a fever or any acute illness.
Usually a child (or adult) will manage to overcome a fever without any intervention at all but if they do become a bit stuck and need a helping hand there are a few homeopathic remedies listed below that may help, and if you are not sure what to do and you are concerned call your Homeopath or your Doctor.

1. Aconite napellus (Acon.)
For the early stage of fever when the onset is rapid and intense, and the fever is high. The fever may have been preceded by a shock or fright, or exposure to a cold, dry wind. The child will be agitated, restless, and anxious. They are usually sweaty and thirsty for cold drinks. Pupils may be constricted.
2. Belladonna (Bell.)
Sudden, violent fever that may lead to delirium. The child will have a bright red or flushed face – especially the cheeks (the right cheek may be more flushed on the left cheek). While the head it is usually hot, the hands and feet will be cold. Pupils will be dilated with an intense headache that is usually throbbing in nature. The headache will feel better for sitting and worse for lying, or being bumped or jarred. The child will feel more comfortable in a darkened room and may crave lemon drink, lemonade, or cold water. They may also be thirstless and / or especially sweaty. Complaints triggering the fever, such as middle ear infections and tonsillitis will usually occur on the right hand side.
3. Ferrum phosphoricum (Ferr-p.)
Useful for the first stage of an acute illness when inflammation is present but it is too early for clearly defined symptoms. The fever may be high but its onset is not as rapid or as intense as is seen with a Belladonna or Aconite fever. The child’s face is usually flushed and there may be reddened patches on the cheeks. Sometimes there will be paleness of the face. The child well be restless and alert but not anxious as with a Belladonna or Aconite fever. There may be redness of the tonsils or ear but if pus is present, or nasal mucus is thick, Ferr-p will no longer be helpful. The child may refuse meat or milk but be thirsty for water.
4. Pulsatilla pratensis (Puls.)
The Pulsatilla fever can be either high or low, but the child will be clingy and easily upset. They want constant cuddles and affection, climbing onto your lap and snuggling into you if you sit down. They feel worse for warmth and stuffy rooms but feel much better when gently carried in fresh air. They are also thirstless with the fever and have changeable moods.
